Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of fanzzer.com (the "Service"), owned and operated by nfluencer llc ("we", "us", "our"), an 18+ creator and fan platform, and your agreement with us. Key provisions include:

• We can modify these Terms at any time
• Subscriptions automatically renew unless you cancel
• Your rights vary depending on your jurisdiction
• Disputes are subject to the dispute-resolution terms below, including arbitration where enforceable

2. Age Requirement and Eligibility

YOU MUST BE AT LEAST 18 YEARS OF AGE TO USE THIS SERVICE.

By registering, you represent and warrant that you are 18 years of age or older and legally able to enter into this agreement. Falsifying your age is strictly prohibited and constitutes a material breach of these Terms. Providing false age information will result in immediate and permanent account termination and ban. Users who misrepresent their age may also be subject to legal action and reporting to authorities.

Adult Activities & Depicted Persons: If creators are performing adult activities, all other persons who appear on video or picture must also be of legal age (at least 18 years of age). Violation of this rule will result in account deletion permanently and an immediate permanent ban from the platform.

3. User Definitions

• Creator: A User who uploads content for Fans to view
• Fan: A User who subscribes to or purchases Creator content
• Subscription: Recurring payment for access to Creator content
• Fan Payment: Any payment related to Creator interactions
• Creator Earnings: Amount credited to a Creator after platform fees (15%) and applicable reversals are deducted
• Payment Processors: Our approved third-party payment processor(s), which may process hosted checkout, subscriptions, renewals, refunds, and chargebacks
• KYC Provider: Ondato, our identity and age verification provider
• Creator Wallet: The internal balance record used to track Creator Earnings before manual payout
• Content: Photos, videos, livestreams, text, and other material Creators upload

4. Account Registration and Responsibilities

To use fanzzer.com, you must:

• Provide accurate, current, and complete information
• Be at least 18 years of age
• Accept responsibility for all activities under your account
• Maintain only one account per person

Creator Requirements: To monetize your posts, you must successfully verify your identity and age through Ondato or another provider we approve in writing. This may include providing government-issued ID, photos, tax information, and other personal information. You must keep verification, tax, and payout information current before we release Creator payouts.

How Creator age verification works: before any monetization feature is enabled on your account, you must submit a government-issued photo ID (such as a driver's license or passport) and a live selfie through our KYC provider's hosted verification flow. The provider authenticates the document, extracts your date of birth directly from it, and compares your selfie against the document photo to confirm you are the person shown. We do not accept a self-reported birthdate as a substitute for this process, and the resulting pass/fail decision is confirmed to us directly by the provider, not from anything your browser reports. Monetization remains disabled unless this verification is confirmed successful and confirms you are at least 18 years of age.

5. Content Ownership and Rights

You retain ownership of all Content you create. By uploading Content to fanzzer.com, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, stream, transmit, distribute, moderate, and technically process your Content for platform operations, safety, legal compliance, and limited platform promotion consistent with your account settings.

You warrant that:

• You own all rights to your Content or have obtained all necessary licenses
• Your Content does not violate any third-party intellectual property rights
• Your Content complies with all applicable laws and these Terms
• You are legally responsible for all Content you upload
• If creators are performing adult activities, all other persons who appear on video or picture must also be of legal age (at least 18 years old), and violation of this rule will result in permanent account deletion
• All people shown or referenced in your Content are adults and have given any required consent, releases, and permissions
• You will maintain records needed to prove age, identity, rights, and consent where required by law, processors, or our policies

6. Prohibited Content and Conduct

Pre-Publication Review: Before any Content becomes visible to other Users, we use automated software to screen it for illegal material and other violations of this Prohibited Content and Conduct policy. Content our software determines is illegal or otherwise violates this policy is not published. Where our software cannot make that determination automatically, the Content is flagged and held for manual review by our team, and is removed if that review confirms a violation, with the Creator's account subject to suspension or termination as described in Section 10. This pre-publication review does not limit our right to remove Content or take other action under this section at any time, including after publication.

You agree NOT to upload or engage in:

• Illegal, harmful, threatening, or defamatory content
• Violence of any kind
• Content that infringes intellectual property rights
• Non-consensual intimate imagery or content without consent
• Unauthorized pictures or images of other people without their explicit written consent
• Content involving anyone under 18, including age-play, simulated minors, or ambiguous-age sexual content; if creators are performing adult activities, all other persons appearing on video or picture must also be of legal age (violation will result in account deletion permanently)
• Artificially generated (AI) images, deepfakes, or synthetic media presented as real content
• Child sexual abuse material (CSAM) or any content involving minors
• Content prohibited by our payment processors, card networks, banking partners, law, or our published creator guidelines
• Fraud, impersonation, or deception
• Harassment, abuse, or threats against other users
• Malware, viruses, or harmful code
• Unauthorized access attempts or system hacking
• Spam, bots, or automated abuse
• Alcohol-related non-consensual sexual acts or drug references
• Autopsy photos
• Bestiality
• Bodily excretions
• Cannibalism
• Child pornography or other content involving minors
• Chloroform or depictions of incapacitation
• Credit card collecting
• Crushing of live bugs or animals
• Depiction of exchange of money for sex
• Gore (blood that has been shed, especially as a result of violence)
• Extreme violence or flogging (severe beating)
• Use of "forced" terminology
• Hypnosis (depicting a person under hypnosis during sexual activity)
• Incest or incest-themed content
• Kidnapping or abduction
• Polygamy dating or content
• Prostitution
• Racist content
• Rape or rape-themed content
• Sacrilegious content
• Self-mutilation
• Sleeping (involving sexual activity with a sleeping person)
• "Snuff" or "fantasy snuff" content
• Suffocation
• Underage content, provocative or non-provocative
• Urination (person-to-person water sports) or vomiting
• Voyeurism — depicting photos, videos, or other content without the consent of the person depicted

7. Fan Subscriptions and Payments

Automatic Renewal: When you click "Subscribe" or complete hosted checkout through our payment processor, you authorize recurring payments at the disclosed price, billing interval, and applicable taxes. Your subscription will renew unless:

• Your payment is declined and you provide no alternate payment method
• You switch off "Auto-Renew" or cancel through the subscription management tools we provide
• The subscription price increases (you must opt-in to new price)
• You cancel before the renewal date
• You delete your account

We will present material subscription terms before checkout and provide cancellation access through the Service or the applicable hosted processor flow. You authorize us and our Payment Processors to charge your payment method for each renewal.

Refunds and Chargebacks: Refund requests for subscriptions, tips, PPV purchases, and digital content purchases are reviewed and handled on a case-by-case basis by the Consumer Support department of the Payment Processor that handled your payment. We do not impose a fixed time limit for submitting a refund request. Bad faith or fraudulent refund or chargeback requests may still result in access limits, account suspension, or account deletion.

8. Creator Payouts and Payment Terms

Platform Fee: fanzzer.com deducts 15% from all Fan Payments as our platform fee. Creator Earnings are credited to your Creator Wallet after this deduction and after the relevant processor confirms the transaction.

• All payments are processed in USD
• Creator Earnings are only available when reflected in your account and eligible for payout
• Minimum payout threshold applies (see account settings)
• Bank fees, currency conversion, and e-wallet charges are your responsibility
• If a Fan chargebacks or receives a refund, we deduct the Creator Earnings portion
• We may delay, reserve, offset, or withhold payouts for fraud, chargeback risk, processor review, tax issues, sanctions screening, legal obligations, or Terms enforcement

Fan Payments are processed by our approved third-party payment processor(s). Creator payouts are handled by MassPay.io: you provide and manage your payout destination directly through MassPay's secure payout portal, and payouts are disbursed through MassPay's platform rather than processed manually. Payout requests and identity verification are managed in your account's Verification and Payouts settings.

9. Tax Compliance

Creators are solely responsible for their tax obligations. You warrant that you have reported, and will report in the future, all earnings from fanzzer.com to relevant tax authorities as required by law.

• We are not liable for tax advice or non-payment of taxes
• We may issue 1099-K or other tax forms as required by law
• Tax non-compliance may result in account suspension or closure
• We may withhold earnings if you become tax non-compliant

10. Account Suspension and Termination

We may suspend or delete your account:

• With 30 days' notice: For any reason
• Immediately without notice: If we believe you have breached these Terms, violated laws, or posed a risk to users
• Immediately and permanently with ban: For falsifying your age, failing to ensure all persons appearing in adult activity videos or pictures are of legal age, posting unauthorized pictures of other people, or uploading AI-generated images presented as real content. Violation of this rule will result in account deletion permanently.
• Upon your request: You may delete your account anytime via account settings

Upon deletion, your account and Content will be removed from active user-facing systems within 30 days unless we must retain records for payment, payout, tax, chargeback, fraud-prevention, safety, legal, or processor-compliance reasons. You will not be able to recover deleted accounts or Content. Any refund request related to account deletion is handled per the case-by-case process described in Section 7. Users banned for age falsification, adult activity age compliance violations, unauthorized images, or AI content violations are permanently prohibited from creating new accounts and may be reported to relevant authorities.

11. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Defects will be corrected
• The Service is free from viruses or harmful components
• Creator Earnings will meet expectations
• Results from using the Service will be accurate or reliable

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, fanzzer.com, ITS OPERATORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (A) 100% OF FEES YOU PAID IN THE PAST 12 MONTHS, OR (B) $250.

13. ARBITRATION AND CLASS ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPUTES MUST BE BROUGHT INDIVIDUALLY AND NOT AS A CLASS ACTION.Where enforceable, disputes shall be resolved through binding arbitration under the American Arbitration Association rules. You and fanzzer.com waive the right to a jury trial for claims subject to arbitration. Nothing in these Terms limits rights that cannot be waived under applicable law.

14. Dispute Resolution and Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration. You agree to:

• Notify us of any dispute before filing
• Attempt mediation if requested
• Submit to binding arbitration in Delaware
• Not pursue class action lawsuits

Failure to comply with dispute resolution procedures is a material breach of these Terms.

15. Indemnification

You agree to indemnify and hold harmless fanzzer.com, its operators, employees, and agents from any claims, damages, obligations, losses, or expenses (including attorney's fees) arising from:

• Your use of the Platform
• Your breach of these Terms
• Your violation of any third-party rights
• Content you upload or create
• Your interactions with other users

16. Intellectual Property

You confirm that your Content does not infringe any third-party intellectual property rights and that you own or have obtained all necessary rights to upload it.

We respect intellectual property rights and respond to valid DMCA takedown requests in accordance with applicable law. The DMCA process may be initiated at legal@fanzzer.com.

17. Modifications to Terms

We may modify these Terms at any time. Changes take effect immediately upon posting. We will notify you of material changes via email. Your continued use of the Platform constitutes acceptance of modified Terms. If you do not agree with changes, you may delete your account.

18. Data Deletion and Account Closure

You can request account closure and deletion of personal data, subject to permitted retention. When you delete your account:

• Profile data and Content are removed from active user-facing systems within 30 days unless retention is required
• Deleted data cannot be recovered
• You lose access to your account immediately

We retain records as required by law or for legitimate business purposes, including tax, accounting, payment reconciliation, processor disputes, chargebacks, fraud prevention, safety enforcement, and legal claims.

19. Third-Party Services

We integrate with third-party services that have their own privacy policies and terms. We are not responsible for their practices. Your use of these services is governed by their terms, not ours.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of Delaware. Any legal action must be brought in the courts of Delaware. For international users, you consent to Delaware jurisdiction for all disputes.

21. General Provisions

• If any provision is unenforceable, remaining provisions remain in effect
• Failure to enforce a provision is not a waiver
• No agency, partnership, or employment relationship is created
• You cannot assign your rights under these Terms
• These Terms constitute the entire agreement between us
