This Privacy Policy explains how fanzzer.com ("NFLUENCER LLC, the owner of fanzzer.com", "we," "us," "our," or "Company") collects, uses, shares, and safeguards your personal data when you use our 18+ creator and fan platform ("Service"). This policy applies to fanzzer.com and all related properties.

We collect information directly from you, automatically through your use of the Service, and from third parties as necessary.
Direct Collection:
- Account information: name, email, phone, username, password
- Identity and age verification: date of birth, government ID, photos, and verification status
- Payment information: billing details, hosted checkout status, payment method tokens, processor identifiers, refunds, and chargebacks
- Creator information: subscription price, tax details, payout method, wallet balance, payout queue status, and earnings records
- Content: text, photos, videos, livestreams
- Safety records: reports, moderation decisions, consent or release records where required, and account enforcement history
- Profile information: bio, profile picture, verified badges
- Communications: messages, support tickets, feedback
Automatically Collected:
- Technical data: IP address, browser type, device type, OS
- Usage data: pages visited, time spent, clicks, searches
- Analytics: referring URL, features used, download history
- Cookies and trackers: session identifiers, preferences, analytics

4. Your Data Rights and Content Ownership
You retain ownership of your content and can exercise privacy rights over your personal data.

- Deletion: You can delete your account and request deletion of personal data, subject to permitted retention

5. Data Deletion and Account Termination
When you delete your account, we remove or de-identify account data that is no longer needed, subject to legal, safety, payment, tax, and fraud-prevention retention requirements.
The deletion process:
- Immediate: Your account becomes inaccessible immediately
- Within 30 days: Profile data and user content are removed from active systems unless retention is required
- Irreversible: Deleted data cannot be recovered
- Limited Retention: Transaction, payout, tax, chargeback, safety, and legal records may be retained as described below
Exceptions - We retain only:
- Tax records (7 years per IRS requirements)
- Legal holds (as required by court order)
- Payment, refund, chargeback, and payout records needed for processor reconciliation and accounting
- Fraud prevention, safety, and Terms enforcement records for a limited period
6. Data Sharing and Third Parties
We share data only with necessary service providers and as required by law.
Essential Service Providers:
- CCBill and Segpay: Hosted checkout, card processing, subscriptions, refunds, chargebacks, and processor records
- Ondato: KYC, age, and identity verification for creators and other users when required
- Clerk: Authentication, account management, and session security
- Cloudflare: CDN, hosting, DDoS protection
- Email Service: Transactional emails
Required Sharing:
- Tax authorities (for required tax forms and reporting)
- Law enforcement (with valid legal process)
- Court orders (subpoenas, warrants)
- Child protection (NCMEC reports for CSAM)
What We Don't Do:
- We do NOT sell your personal data to third parties
- We do NOT share with marketers or advertisers
- We do NOT share sensitive payment information except with payment processors and service providers needed to process transactions, prevent fraud, and comply with law
- We do NOT share with data brokers
8. Data Security
We implement industry-standard security measures to protect your data:
- HTTPS encryption for all data in transit
- Encryption at rest for sensitive data
- Secure password hashing and salting
- Security reviews and testing appropriate to the Service
- Access controls and role-based permissions
- Intrusion detection and monitoring

Limitation: No security system is 100% secure. While we implement best practices, we cannot guarantee absolute protection. You are responsible for maintaining password security and protecting your account.
9. Content and Creator Data
Your content and Creator data have special protections:
- Ownership: You retain full ownership and copyright of all content
- License: You grant us only a license to host and deliver content
- Creator Data: KYC, tax, wallet, payout queue, and payout information are processed by us and our verification, payment, accounting, and payout service providers
- Safety Review: We may review, restrict, preserve, or remove content to enforce age, consent, legal, processor, and platform rules
- Backup: Content is backed up for service continuity
- Deletion: Content is removed from active user-facing systems when you delete your account unless preservation is required
10. Children and Minors
fanzzer.com is only for users 18 years of age or older.
- We do not knowingly collect data from anyone under 18
- If we discover a minor's account, we delete it immediately
- Parents/guardians: Contact privacy@fanzzer.com if concerned
- We comply with COPPA (Children's Online Privacy Protection Act)
11. Data Retention Periods
We retain data only as long as necessary:
- Active Accounts: Data retained while account is active
- Deleted Accounts: Profile data and content removed from active systems within 30 days unless retention is required
- Tax Records: 7 years (IRS requirement)
- Payment and Payout Records: As needed for accounting, processor reconciliation, refund, chargeback, and legal obligations
- Fraud and Safety Records: As needed to protect users, prevent repeat abuse, and enforce our Terms
- Legal Holds: As required by law or court order
- Backups: Deleted data removed from backups within 90 days
12. GDPR Compliance (European Users)
If you are located in the European Union, you have additional rights under the General Data Protection Regulation (GDPR):

Legal Basis: We process account, subscription, and content-delivery data to perform our contract with you; payment, tax, KYC, and safety records to comply with legal obligations; fraud, security, analytics, and enforcement data for legitimate interests; and marketing or optional cookies where consent is required.
13. CCPA Compliance (California Users)
If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the CPRA (CCPA/CPRA). Depending on your relationship with us, we may collect identifiers, commercial information, internet activity, geolocation at city/country level, professional or creator profile information, user content, inferences, and sensitive personal information such as government ID, payment-related information, and precise identity verification data when required.
